CLA Submits Request for Extension for Comments on Use of Pesticide Treated Seed

Last week, the Environmental Protection Agency (EPA) issued an advanced notice of proposed rulemaking to seek information on the use of pesticide treated seed. While the pesticides used to treat seed are regulated under Federal Insecticide, Rodenticide, and Fungicide Act (FIFRA), EPA exempts treated seed itself from regulation if it meets the requirements of the regulatory treated article exemption. The feedback EPA is seeking is intended to help inform whether and to what extent EPA may regulate treated seed in the future. The agency is seeking comments on how growers manage these products, the extent to which they are used, and other information. The current comment period ends December 11. On October 16, CLA submitted a 60-day extension request to allow more time for stakeholders to provide substantive comments.
